Terms of Service

These Terms of Service ("Terms") govern your access to and use of BotWitness (the "Service"), operated by BotWitness LLC ("we", "us", "our"). By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.

1. What the Service is

BotWitness records, on a recurring schedule, what public sources publish about how they treat automated agents and AI crawlers, for example, a website's robots.txt and llms.txt files, and related public disclosures and registries. Each capture is cryptographically hashed and bound to an independent RFC-3161 trusted timestamp. We make these records available through a web dashboard, an API, downloadable Certificates of Capture, and change alerts.

2. The record is evidence, not advice

A BotWitness record attests to what a specified public resource returned at a stated time, according to our documented and consistent methodology. It is supporting evidence about a public source. It is not legal advice, and we do not guarantee that any record will be admitted or given particular weight by any court, regulator, or other body. You are responsible for how you interpret and use the records, and you should consult qualified professionals for legal, compliance, or evidentiary decisions.

We capture public resources on a best-effort basis. A source may be temporarily unreachable, may block automated requests, or may change between captures; where that happens, the record reflects what we observed, including the fact of an error or absence.

3. Accounts and API keys

You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under them. Treat an API key like a password. You can view, copy, and rotate your keys from your dashboard; rotating a key immediately disables the previous one. Notify us promptly at [email protected] if you believe a key has been compromised.

4. Plans, billing, and renewals

5. Acceptable use

You agree not to: (a) resell or redistribute the Service or bulk-export the archive except as expressly permitted by your plan; (b) attempt to circumvent rate limits, access controls, or metering; (c) use the Service to violate any law or infringe the rights of others; or (d) interfere with or disrupt the integrity or performance of the Service.

6. Availability and warranties

We work to keep the Service reliable, but it is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific source will be captured on any specific day.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months preceding the event giving rise to the claim.

8. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you materially breach these Terms or use the Service in a way that risks harm to us, other users, or third parties. Sections that by their nature should survive termination (including 2, 6, 7, and 9) will survive.

9. Governing law

These Terms are governed by the laws of the State in which we are organized, without regard to that State's conflict-of-laws rules, and any dispute will be resolved in the courts of competent jurisdiction located there, unless applicable law requires otherwise.

10. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
